1. Who We Are

NextGen Skills Foundation is a nonprofit organization based in Saint Lucia, recognized by Saint Lucia's Ministry of Equity, Social Justice, Gender, Older Persons, Labour, Cooperatives and Consumer Affairs as operating in compliance with the Non-Governmental Organizations Act. We design and facilitate vocational skills-development projects for young people, in partnership with accredited training provider Shan-Phill Training. This website is nextgenskillsfoundation.com, and we are the "data controller" for the personal data described in this policy. You can reach us at nextgenskillsfoundation@gmail.com.

2. What Data We Collect

We collect information in two ways:

Information you give us directly

When you use the "Get Involved" form on our homepage, we ask for: the option that best describes you (prospective participant, parent or guardian, school or facility, partner or sponsor, or volunteer), your full name, your email address, an optional organization name, and any message you choose to write. We do not ask for payment details, government ID numbers, or any information beyond what that form requests.

Information collected automatically

When Google Analytics 4 is active (see Section 5), it collects standard analytics data such as pages viewed, approximate location (city/country level, derived from IP address), device and browser type, and how you arrived at the site. This data is pseudonymous — GA4 is not used to identify you personally — and is only collected after you accept analytics cookies through the consent banner described in Section 5.

3. Why We Collect It

• To respond to inquiries, referrals and applications submitted through the Get Involved form.
• To keep track of programme participants, referring schools, partners and sponsors.
• To understand, in aggregate, how visitors use this website so we can improve it — for example, which pages are most useful and where visitors are located.

We do not sell personal data, and we do not use the information you submit for advertising or profiling.

4. Legal Basis for Processing GDPR — Art. 6

For visitors in the EU, EEA or UK, our legal bases for processing personal data under the GDPR are:

• Consent — for analytics cookies (GA4), which only load after you accept them through the CookieYes consent banner.
• Legitimate interest — for responding to messages you send us through the Get Involved form, where our interest in running the Foundation's programmes is balanced against your privacy rights.
• Consent — where you voluntarily submit a message, application or referral through the form, you are consenting to us using that information to respond.

You may withdraw consent at any time — for cookies, by reopening the consent settings described in Section 5; for form submissions, by emailing us at the address in Section 19.

5. Cookies & Tracking Technologies

This site uses CookieYes as its consent management platform to gather and record your cookie preferences in a way that satisfies GDPR/ePrivacy and CCPA requirements. On your first visit, a banner lets you accept or decline non-essential cookies; you can change your choice at any time via the "Manage Cookie Preferences" control CookieYes adds to the page.

Google Analytics 4 (_ga/_ga_* cookies) only loads after you accept analytics cookies in the CookieYes banner. If you decline, GA4 does not run and no analytics cookies are set. You can withdraw consent at any time, and your browser's own settings let you block or delete cookies generally.

6. Third-Party Services We Use

• Google Analytics 4 — website analytics. Google's privacy practices are described at policies.google.com/privacy. Only active after you consent (Section 5).
• CookieYes — manages and records your cookie consent choice. See CookieYes's privacy policy.
• Formspree — processes and delivers Get Involved form submissions to us by email. See Formspree's privacy policy. We do not store form submissions in any public repository.
• Google Fonts — typefaces are loaded from Google's font CDN.

This site does not use WhatsApp, Facebook Pixel, PayPal or any advertising network. If that changes, this page will be updated first.

7. International Data Transfers GDPR

Because our third-party service providers (Google, CookieYes, Formspree) operate globally, data collected through this site may be transferred to and processed in countries outside your own, including the United States. Where this involves transferring personal data out of the EU/EEA/UK, those providers rely on mechanisms such as the EU-US Data Privacy Framework or Standard Contractual Clauses to provide an adequate level of protection, as required by GDPR Chapter V.

8. Your Rights Under GDPR EU / EEA / UK

If you are located in the EU, EEA or UK, you have the right to:

9. Your Rights Under CCPA/CPRA California

If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) gives you the right to know what personal information we collect, request deletion of it, correct inaccurate information, and opt out of the "sale" or "sharing" of personal information.

10. Other US State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Indiana, Tennessee and other US states with comprehensive privacy laws have similar rights to access, correct, delete and obtain a copy of their personal data, and to opt out of targeted advertising or profiling — neither of which this site engages in. To exercise these rights, contact us using the details in Section 19.

11. Caribbean Residents' Rights

NextGen Skills Foundation is based in Saint Lucia and most of our participants, partners and visitors are in the Caribbean. Several Caribbean jurisdictions have their own data protection frameworks — for example Jamaica's Data Protection Act, Trinidad and Tobago's Data Protection Act, and Bermuda's Personal Information Protection Act. Where you have rights under the law of your own jurisdiction to access, correct or request deletion of your personal data, we honor those requests on the same terms described for GDPR in Section 8, contacted via the details in Section 19.

12. Children's Privacy

This website is not directed at children under 13, and we do not knowingly collect personal information directly from children under 13 through the Get Involved form. NextGen Skills Foundation's programmes serve young people generally aged 15 and older; where a prospective participant is a minor, we expect a parent, guardian or referring school to be involved in the inquiry, application and enrollment process. If we learn that a child under 13 has submitted personal information directly, we will delete it. Parents or guardians who believe their child has provided us with information can contact us using the details in Section 19 to request its removal.

13. Commercial Email

NextGen Skills Foundation does not currently operate an email marketing list or send promotional email campaigns — email is used only to respond to inquiries submitted through the Get Involved form. If that changes in the future, any commercial email we send will comply with the US CAN-SPAM Act: accurate sender information, a clear subject line, our physical location, and a working way to opt out of future messages.

14. Accessibility

NextGen Skills Foundation is committed to making this website usable by everyone, including people using assistive technology. This site is built to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, including: descriptive alternative text on meaningful images, sufficient color contrast between text and background, full keyboard navigability, semantic landmark structure for screen readers, and visible focus indicators on every interactive element. If you encounter an accessibility barrier anywhere on this site, please tell us using the details in Section 19 so we can fix it.

15. Data Retention

We keep personal data only as long as necessary for the purposes described in this policy:

You may request earlier deletion of personal data we hold about you, subject to any legal obligation we may have to retain it, by contacting us using the details in Section 19.

16. Security

We take reasonable technical and organizational measures to protect personal data, including:

• HTTPS encryption enforced on every page (TLS/SSL).
• A strict Content Security Policy restricting which scripts and resources this site can load.
• No storage of payment information — this site does not process payments.
• No local database of visitor personal information; form submissions are handled by Formspree and delivered to us by email.

No method of transmission over the internet is 100% secure. In the unlikely event of a data breach likely to result in a risk to your rights, we will notify affected individuals and, where required, relevant supervisory authorities without undue delay (within 72 hours under GDPR where feasible).

By using this website, you agree to these Terms of Service. If you do not agree, please do not use this website.

Acceptable Use

You agree to use this website only for lawful purposes, and not in any way that is unlawful, harmful, fraudulent, misleading, or that infringes the rights of others. You must not attempt to gain unauthorized access to this website or its underlying infrastructure.

Intellectual Property

All content on this website — text, images, logos and design — is the property of NextGen Skills Foundation unless otherwise credited. You may not reproduce, distribute or create derivative works from this content without prior written permission.

Accuracy of Information

We make reasonable efforts to keep information on this site accurate and current, but we make no warranty regarding its completeness or fitness for any particular purpose. Programme details, partner information and contact details are subject to change without notice.

External Links

This website links to external platforms including Instagram. We are not responsible for the content or privacy practices of external sites, and accessing them is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, NextGen Skills Foundation is not liable for any indirect, incidental or consequential damages arising from your use of, or inability to use, this website.

Disclaimer of Warranties

This website is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Governing Law

These Terms are governed by the laws of Saint Lucia, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your own jurisdiction requires otherwise. Nothing in these Terms limits any statutory rights you have under EU consumer-protection law or US federal or state consumer-protection law.

For material changes — particularly any that affect how we process personal data or limit your rights — we will make reasonable efforts to give notice on the website homepage.
