1. Who We Are

This Legal & Privacy page covers two separate organizations that share this web domain and this one policy page. Each is its own "data controller" for the data collected through its own page — one organization is not responsible for the other's data practices.

NextGen Skills Foundation

NextGen Skills Foundation is a nonprofit organization based in Saint Lucia, recognized by Saint Lucia's Ministry of Equity, Social Justice, Gender, Older Persons, Labour, Cooperatives and Consumer Affairs as operating in compliance with the Non-Governmental Organizations Act. It designs and facilitates vocational skills-development projects for young people. Its page is nextgenskillsfoundation.com, and it is the data controller for personal data submitted through that page (Sections 2–3, 5–6 describe what it collects). Shan-Phill Training

Shan-Phill Training is a private skills-training and certification provider based in Saint Lucia, offering CVQ, certificate and professional-development courses. It shares a founder with NextGen Skills Foundation, but is a separate business and a separate data controller. Its page is nextgenskillsfoundation.com/shan-philltraining.html, and it is the data controller for information handled through that page (see Sections 2–3 and 6 for how its enquiry/application process differs from NextGen's). 2. What Data We Collect

Google Analytics 4 and the CookieYes consent banner run identically across every page on this domain — the NextGen Skills Foundation homepage, the Recognition & Endorsements page, and the Shan-Phill Training page. When active, GA4 collects standard analytics data such as pages viewed, approximate location (city/country level, derived from IP address), device and browser type, and how you arrived at the site. This data is pseudonymous — GA4 is not used to identify you personally — and is only collected after you accept analytics cookies through the CookieYes banner described in Section 5. If you decline, none of it is collected on any page.

NextGen Skills Foundation

When you use the "Get Involved" form on the NextGen Skills Foundation homepage, it asks for: the option that best describes you (prospective participant, parent or guardian, school or facility, partner or sponsor, or volunteer), your full name, your email address, an optional organization name, and any message you choose to write. That form submission is sent to NextGen Skills Foundation via Formspree (Section 6) and is not visible to Shan-Phill Training. It does not ask for payment details, government ID numbers, or any information beyond what that form requests.

Shan-Phill Training

The Shan-Phill Training page's "Apply / Register" tool is a multi-step wizard that asks which programme you're interested in, your full name, your email address, your phone number, and (optionally) your employment status. While you are filling it in, this information stays in your own browser — nothing is transmitted anywhere. When you press "Send via WhatsApp" at the final step, two things happen at the same time: (1) the information is used to pre-fill a WhatsApp message and hand you off to WhatsApp, where WhatsApp (Meta) receives and delivers that message only if you then press send within WhatsApp itself, under its own privacy policy linked in Section 6; and (2) the same information (programme, name, email, phone number, and employment status if provided) is submitted directly to Shan-Phill Training by email, via a Formspree form separate from NextGen's (Section 6). This Formspree submission happens automatically the moment you press "Send via WhatsApp" — it does not require you to complete the WhatsApp step, and it still happens even if you close WhatsApp afterward without sending that message there. If you close the page before reaching the final step and pressing "Send via WhatsApp," nothing is collected by anyone. This is unaffected by the site-wide GA4/CookieYes setup described above, which governs analytics only, not this wizard.

3. Why We Collect It

Where you consent to analytics cookies, GA4 data collected across every page on this domain is used to understand, in aggregate, how visitors use the site so it can be improved — for example, which sections are most useful and where visitors are located.

NextGen Skills Foundation collects information to:

• Respond to inquiries, referrals and applications submitted through the Get Involved form.
• Keep track of programme participants, referring schools, partners and sponsors.

Shan-Phill Training uses the information entered into its Apply/Register wizard to identify which programme you're asking about and to respond to you — both through the WhatsApp conversation and through the emailed copy it receives via Formspree, described in Section 2. It is not used for any other purpose, and is not analyzed or profiled.

Neither organization sells personal data or uses the information you submit for advertising or profiling.

4. Legal Basis for Processing GDPR — Art. 6

For visitors in the EU, EEA or UK, our legal bases for processing personal data under the GDPR are:

• Consent — for analytics cookies (GA4), which only load after you accept them through the CookieYes consent banner.
• Legitimate interest — for responding to messages you send us through the Get Involved form, where our interest in running the Foundation's programmes is balanced against your privacy rights.
• Consent — where you voluntarily submit a message, application or referral through the form, you are consenting to us using that information to respond.

You may withdraw consent at any time — for cookies, by reopening the consent settings described in Section 5; for form submissions, by emailing NextGen Skills Foundation at the address in Section 19.

For Shan-Phill Training, no data is processed until you press "Send via WhatsApp" in the Apply/Register wizard — at that point, the legal basis for both resulting data flows (the WhatsApp handoff and the Formspree email copy sent to Shan-Phill Training, described in Section 2) is your own consent to make contact, given by that single action.

5. Cookies & Tracking Technologies

Every page on this domain — the NextGen Skills Foundation homepage, the Recognition & Endorsements page, and the Shan-Phill Training page — uses CookieYes as its consent management platform to gather and record your cookie preferences in a way that satisfies GDPR/ePrivacy and CCPA requirements. On your first visit to any of these pages, a banner lets you accept or decline non-essential cookies; you can change your choice at any time via the "Manage Cookie Preferences" control CookieYes adds to the page. Each page separately stores its own light/dark display preference locally, as shown below.

Google Analytics 4 (_ga/_ga_* cookies) loads across every page on this domain, but only after you accept analytics cookies in the CookieYes banner. Because the consent cookie is set at the domain level, your choice carries across all pages here — accepting or declining once on any page (NextGen, Recognition & Endorsements, or Shan-Phill Training) applies to the others too, without asking again. If you decline, GA4 does not run anywhere on the domain and no analytics cookies are set. You can withdraw consent at any time, and your browser's own settings let you block or delete cookies and local storage generally.

6. Third-Party Services We Use

Used site-wide (NextGen, Recognition & Endorsements, and Shan-Phill Training)

• Google Analytics 4 — website analytics. Google's privacy practices are described at policies.google.com/privacy. Only active after you consent (Section 5).
• CookieYes — manages and records your cookie consent choice. See CookieYes's privacy policy.
• Google Fonts — typefaces are loaded from Google's font CDN.

NextGen Skills Foundation only

• Formspree — processes and delivers Get Involved form submissions by email. See Formspree's privacy policy. Form submissions are not stored in any public repository.

Shan-Phill Training only

• WhatsApp (Meta) — the Apply/Register wizard hands your message to WhatsApp only if you go on to press send within WhatsApp itself, after being handed off there. WhatsApp's own privacy policy, at whatsapp.com/legal/privacy-policy, governs what happens to that message from that point on.
• Formspree — pressing "Send via WhatsApp" also submits your programme, name, email, phone number and employment status (if provided) directly to Shan-Phill Training by email, using a Formspree form of its own, separate from NextGen's. See Formspree's privacy policy. This submission is not shared with NextGen Skills Foundation.

NextGen Skills Foundation and Shan-Phill Training each use their own, separate Formspree form — neither organization sees the other's form submissions, and neither organization's form hands data to WhatsApp. Nothing on this domain uses Facebook Pixel, PayPal, or any advertising network. No page uses any third-party service beyond what is listed above. If that changes for any page, this page will be updated first.

7. International Data Transfers GDPR

Because our third-party service providers (Google, CookieYes, Formspree) operate globally, data collected through this site may be transferred to and processed in countries outside your own, including the United States. Where this involves transferring personal data out of the EU/EEA/UK, those providers rely on mechanisms such as the EU-US Data Privacy Framework or Standard Contractual Clauses to provide an adequate level of protection, as required by GDPR Chapter V.

8. Your Rights Under GDPR EU / EEA / UK

If you are located in the EU, EEA or UK, you have the right to:

9. Your Rights Under CCPA/CPRA California

If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) gives you the right to know what personal information we collect, request deletion of it, correct inaccurate information, and opt out of the "sale" or "sharing" of personal information.

10. Other US State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Indiana, Tennessee and other US states with comprehensive privacy laws have similar rights to access, correct, delete and obtain a copy of their personal data, and to opt out of targeted advertising or profiling — neither of which this site engages in. To exercise these rights, contact us using the details in Section 19.

11. Caribbean Residents' Rights

NextGen Skills Foundation is based in Saint Lucia and most of our participants, partners and visitors are in the Caribbean. Several Caribbean jurisdictions have their own data protection frameworks — for example Jamaica's Data Protection Act, Trinidad and Tobago's Data Protection Act, and Bermuda's Personal Information Protection Act. Where you have rights under the law of your own jurisdiction to access, correct or request deletion of your personal data, we honor those requests on the same terms described for GDPR in Section 8, contacted via the details in Section 19.

12. Children's Privacy

Neither page on this site is directed at children under 13, and neither organization knowingly collects personal information directly from a child under 13. NextGen Skills Foundation's programmes serve young people generally aged 15 and older; where a prospective participant is a minor, NextGen expects a parent, guardian or referring school to be involved in the inquiry, application and enrollment process. Shan-Phill Training's programmes are trade and certificate training generally aimed at working-age adults. If either organization learns that a child under 13 has submitted personal information directly, it will delete it. Parents or guardians who believe their child has provided information to either organization can contact the relevant one using the details in Section 19 to request its removal.

13. Commercial Email

NextGen Skills Foundation does not currently operate an email marketing list or send promotional email campaigns — email is used only to respond to inquiries submitted through the Get Involved form. If that changes in the future, any commercial email we send will comply with the US CAN-SPAM Act: accurate sender information, a clear subject line, our physical location, and a working way to opt out of future messages.

14. Accessibility

NextGen Skills Foundation is committed to making this website usable by everyone, including people using assistive technology. This site is built to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, including: descriptive alternative text on meaningful images, sufficient color contrast between text and background, full keyboard navigability, semantic landmark structure for screen readers, and visible focus indicators on every interactive element. If you encounter an accessibility barrier anywhere on this site, please tell us using the details in Section 19 so we can fix it.

15. Data Retention

We keep personal data only as long as necessary for the purposes described in this policy:

16. Security

We take reasonable technical and organizational measures to protect personal data, including:

• HTTPS encryption enforced on every page (TLS/SSL).
• A strict Content Security Policy restricting which scripts and resources this site can load.
• No storage of payment information — this site does not process payments.
• No local database of visitor personal information; form submissions are handled by Formspree and delivered to us by email.

No method of transmission over the internet is 100% secure. In the unlikely event of a data breach likely to result in a risk to your rights, we will notify affected individuals and, where required, relevant supervisory authorities without undue delay (within 72 hours under GDPR where feasible).

This website links to external platforms including Instagram. We are not responsible for the content or privacy practices of external sites, and accessing them is at your own risk.

Governing Law
